If I was hit by a commercial truck driver, is the company responsible?

If a collision involving a commercial truck has occurred, and the truck driver was at fault, either the truck driver, the truck company or both parties may be responsible.

Under the theory of respondeat superior, a truck company can be held liable for the actions of its employees as long as the action was committed in the scope of the truck driver’s employment. It is beneficial for truck accident victims when the truck company can be held liable, because the company is much more likely to have the ability to pay for damages.

There are some situations that may affect the ability to hold the truck company responsible, for instance if the driver was an independent contractor, if the accident occurred when the driver was off-duty or if the driver committed an intentional crime. However, these factors may affect your case in complex ways, so always consult with an attorney.
